A balance of privacy and dignity

The Supreme Court held that whenever there is tension between two rights — privacy of a few and dignity of a majority — the court should intervene to balance it. Justice A.K. Sikri, writing for the majority on the Constitution Bench, “whenever such tension arises, the task of balancing is to be achieved by the courts”. In this case, Justice Sikri held that right of personal autonomy is also a part of dignity (and right to privacy). Another part of dignity of the same individual is to lead a dignified life as well, which is again a facet of Article 21 of the Constitution. “Therefore, in a scenario where the State is coming out with welfare schemes, which strive at giving dignified life in harmony with human dignity and in the process some aspect of autonomy is sacrificed, the balancing of the two becomes an important task,” the Supreme Court held. The court held that the judiciary cannot cannot be the reason for undue intrusion into the conferment of economic benefits to a large section of the society.
