Acquitted of Negligence.

Their Lordships [Sadasiva Aiyer and Napier, J.J., of the Madras High Court] disposed of a criminal revision case from North Arcot in which the question was whether negligence on the part of a driver of a Motor car could be inferred from the fact that the car ran over a man and caused his death, when the accused denies the occurrence and does not explain how the man was run over. The facts of the case are that the Sri Mahant of Tirupati who went to Chittore to attend a War Loan meeting returned to Tirupati in his Motor car. On the way the car ran over an old man who was on the road near the village of Perenallapalh and the man died two days later. The driver of the car denied all knowledge of the occurrence.
