NATIONAL COMPANY LAW APPELLATE TRIBUNAL (NCLAT)

  • NCLAT was constituted in 2016 under Section 410 of the Companies Act, 2013 for hearing appeals against the orders of National Company Law Tribunal(s) (NCLT).
  • It is a is a quasi-judicial body that adjudicates issues relating to Indian companies.
  • NCLAT is also the Appellate Tribunal for hearing appeals against:
  • Orders passed by NCLT(s) under Section 61 of the Insolvency and Bankruptcy Code, 2016.
  • orders passed by Insolvency and Bankruptcy Board of India under Section 202 and Section 211 of IBC.
  • Order passed by the Competition Commission of India (CCI)
  • Orders of the National Financial Reporting Authority.
  • No criminal court shall have jurisdiction to entertain any suit in respect of any matter which the Appellate Tribunal is empowered to determine.
